When a person passes away, the inheritance process begins to transfer the deceased's assets and money to their heirs. To make this transfer, heirs must sign an Acceptance of Inheritance, a document where assets are listed and distributed, formally integrating them into the heirs’ estates. This acceptance is essential for heirs to acquire any of the deceased's assets, whether it’s a property, vehicle, or funds.


🔸 Declaration of Heirs "Ab Intestato"

If the deceased did not leave a will, the heirs must obtain a notarized document called the Declaration of Heirs Ab Intestato. This document, following legal guidelines, defines who the legal heirs are, ensuring that the inheritance is distributed according to the law.


✅ Requirements for a Declaration of Heirs "Ab Intestato"


Identification Documents of the Parties Involved:


  • Spanish Citizens: DNI

  • Foreign Nationals: NIE with photo, or NIE without photo accompanied by a passport or residence card.

Documents of the Deceased:


  • Original death certificate.

  • Certificate of last will (we can help you obtain this if needed).

  • Witnesses: Two witnesses who knew the deceased and can sign the deed.

  • Proof of Deceased’s Residence: Original DNI or proof of registration.


To Verify Children of the Deceased:


  • Family record book or children’s birth certificates.

  • If any of the deceased’s children passed away, their death certificate and family record book or birth certificates of their descendants will be required.


If Siblings of the Deceased are Heirs:


  • Birth certificates of the siblings.


Spouse Documentation (as required by the corresponding Civil to be applied):


  • If Married: Original marriage certificate.

  • If Widowed: Spouse’s death certificate.

  • If Divorced or Legally Separated: Original divorce or separation judgment.
